URGENT ACTION: International Volunteer deported from Colombia

CHRISTINA FRIEDERIKA MÜLLER A RESEARCHER WITH MASTERS IN COMMUNICATIONS

We, the undersigned organisations, members of the Network of Solidarity and Friendship with Colombia denounce to the national and international community the deportation from Colombia of Christina Friederika Müller, a German citizen who was providing accompaniment to human rights organisations.

We categorically reject this arbitrary and unjust actions carried out by the Colombian Security Service (DAS) in the city of Cali.

The investigator was the victim of several arbitrary actions: illegal deprivation of her liberty, prevented from being in communication with lawyers and deportation. Finally she has been banned from returning to Colombia for seven years as “she endangers national security, public order, public health, social tranquility, public security, or that existing intelligence information indicates that she represents a risk to national security, public order, public health, social tranquility, public security" according to the Colombian Security Service.

Christina had been invited by various Colombian human rights organisations that belong to the Network of Solidarity and Friendship with Colombia in order to carry out an investigation into the impacts of human rights violations in various parts of the country.

This case, along with many others, clearly shows the government’s policy of preventing internationals from verifying the serious human rights violations that have occurred under this government

Christina had participated in several accompaniments organised by COS-PACC, the organisation that invited her to Colombia. A delegation of nationals and internationals, including Christina, visited communities in the Provincia de la Libertad, Boyacá, in which Colombia’s Vice-president and the Ombudsman office participated.

The Facts

1. On 1st October 2008, at 5.30pm Christina Friederika Müller, a German citizen was walking in the Plaza de San Francisco, in the city of Cali with a member of the Cali branch of the Solidarity Committee with Political Prisoners and a member of the Yumbo branch of Sintrametal, Union of Workers in the Metal Industry.

2. As they were about the leave the plaza she was approached by five people, who without showing any identification claimed to be employees of the Colombian Security Service (D.A.S.).  They interrogated her as to her reasons for her stay in our country. Immediately these people took her to the Security Services facilities.

3. The lawyers for NOMADESC (Association for the Investigation and Social Action) and for the Solidarity Committee with Political Prisoners went to the Social Services facilities in order to find out what was happening with Christina Friederica. The D.A.S. custody personnel initially denied that they were detaining her. Hours later, Jhon Mario Valencia, a D.A.S. employee informed them that the German citizen was indeed present in the facilities and her status in the country was being investigated in order to determine her entry in to the country. 

4. Later, Oscar Vasco, the D.A.S. employee in charge of her case arrived. He said that the Head of Immigration for the Security Services had declared that she could be detained for up to seventy two hours without being allowed any contact, including her right to an interview with her lawyer. Her mobile telephone was confiscated. D.A.S. personnel refused to accept documents which would require them to supply information as to the reasons for the deprivation of her liberty.

5. Finally on 1st October 2008, at 1:40pm the Security Services deported Christina Friederika Muller from Colombia. This deportation took place ignoring international laws:

   1. She was subject to the deprivation of her liberty, without a warrant.

   2. The Security Services refused to communicate between 30th September and the morning of 1st October.

   3. Christina Friederika was not allowed to have an interview with the lawyer

   4. Christina Friederika was subjected to extensive interrogation while detained by the Security Services without allowing her to be accompanied by her lawyer.

   5. On 1^st October 2008 the Vice-President of Immigration for the Security Services, Lilia María Babativa Velásquez, ordered for Christina Friederika to be deported, without allowing her the right to a defence, nor to give any notice of appeal against this decision.

   6. Christina Friederika was only allowed an interview with her lawyer 15 minutes before being deported.

These facts that we denounce and condemn represent a clear attack against the work of defending human rights in Colombia. It has a clear expressed purpose of preventing the international community from observing, documenting and denouncing the policies and systematic practices of the Colombian government that threaten life, liberty and personal integrity, as well as fail to recognise economic, social and cultural rights.

We, organisations of this Network, are worried that this policy is becoming a recurring practice. Already various members of the international community have suffered these violations.

Therefore, we call with urgency, for you to address the Colombian authorities, Embassies in every country, human rights intergovernmental and Colombian diplomats, with the aim of calling for:

Requests

1.       That the members of D.A.S who participated in the illegal and arbitrary detention of Christina Friederika Müller and the employees who participated in process of this arbitrary deportation are investigated.

2.      That decree 4000 of 2004 is abolished, which concerns “regulation of the issuing of visas, control of foreigners, and other regulations concerning migration” in relation to the expulsion and deportation of foreigners. This contravenes international law and human rights as leaves the restriction and elimination of human rights (amongst other, those of the right to a defence and due process) up to the arbitrary judgment of administrative personnel. 

3.      That the national government explains the policy it is exercising against international citizens and organisations, accompaniers and aid workers.

EXPULSADA DE COLOMBIA

LA  INVESTIGADORA Y MAGISTER EN COMUNICACIÓN CHRISTINA FRIEDERIKA MÜLLER

Las organizaciones abajo firmantes, miembros de la red de Hermandad y Solidaridad con Colombia, denunciamos ante la comunidad nacional e internacional y rechazamos categóricamente  los hechos arbitrarios e injustificados,  por medio de los cuales el Departamento Administrativo de Seguridad DAS, de la ciudad de Santiago de Cali, Valle del Cauca, procedió a Expulsar del País a CHRISTINA FRIEDERIKA MÜLLER, de Nacionalidad Alemana quien realizaba acompañamiento a Organizaciones De Derechos Humanos.

La investigadora fue victima  de varias arbitrariedades, privación ilegal de la libertad, incomunicación, y expulsión con prohibición de regresar al país durante siete  años por "poner en peligro la seguridad nacional, el orden público, la salud pública, la tranquilidad social, la seguridad pública, o cuando existan informaciones de inteligencia que indiquen que representa un riesgo para la seguridad nacional, el orden público, la seguridad pública o la tranquilidad social" según el Departamento de Seguridad DAS de Colombia".

CHRISTINA FRIEDERIKA MÜLLER, había sido invitada, por varias organizaciones de derechos humanos de Colombia pertenecientes a la Red de Hermandad y Solidaridad con Colombia, con el fin de efectuar una investigación sobre los impactos de las violaciones de derechos humanos en varias regiones del país. Este caso como muchos otros, muestran claramente la política de el gobierno en el sentido de impedir a nacionales e internacionales verificar las graves violaciones de derechos humanos cometidas durante este gobierno.

CHRISTINA FRIEDERIKA MÜLLER, había participado en varias actividades de acompañamiento convocadas por COS-PACC, organización que la invitó al país. Entre ellas en la Misión de acompañamiento a las comunidades de la Provincia de la Libertad, en el departamento de Boyacá, convocada por COS-PACC, de la cual participaron la Vicepresidencia de la República y la Defensoría del Pueblo.

LOS HECHOS

1.    El día primero de octubre de 2008 a las 5:30 de p.m. aproximadamente la ciudadana alemana CHRISTINA FRIEDERIKA MÜLLER, se encontraba transitando en la plazoleta de San Francisco de la ciudad de Cali en compañía de un integrante del Comité de Solidaridad con los Presos Políticos Seccional Valle del Cauca y del Sindicato de Trabajadores de la Industria Metalúrgica "SINTRAMETAL"-Yumbo.

2.    Una vez se disponía a abandonar la plazoleta fue abordada por cinco (5) personas quienes sin exhibir documentación alguna manifestaron ser funcionarios del Departamento Administrativo de Seguridad D.A.S., seguidamente la interrogaron acerca de las razones de su estadía en nuestro país. Inmediatamente dichas personas procedieron a trasladarla a las instalaciones del D.A.S.

3.    Los abogados de la Asociación para la Investigación y Acción Social NOMADESC y la Fundación Comité de Solidaridad con los Presos Políticos,  se hicieron presentes en las instalaciones del D.A.S. a efecto de indagar por la suerte de CHRISTINA FRIEDERIKA, negándose inicialmente su privación de la libertad por personal de custodia del D.A.S.

Horas después, el funcionario JHON MARIO VALENCIA manifestó que efectivamente la ciudadana alemana se encontraba en las instalaciones y que estaba siendo objeto de verificaciones para determinar su ingreso al país.

4.    Posteriormente se hizo presente el funcionario ÓSCAR VASCO quien dijo ostentar el cargo de Jefe de Extranjería del organismo de seguridad, el cual manifestó que ella podía estar bajo el recaudo de dicho organismo hasta por setenta y dos horas, siendo incomunicada y negándosele el derecho a entrevistarse con su abogado. A CHRISTINA FRIEDERIKA le fue incautado su teléfono celular.

Personal del D.A.S. se negó a recibir escritos en los que se requería información sobre las razones de la privación de la libertad.

5.    Finalmente el 1 de octubre de 2008, siendo la 1:40 de la tarde, por parte del D.A.S. fue expulsada de Colombia CHRISTINA FRIEDERIKA MÜLLER. Dicha expulsión se realizó desconociendo las normas del derecho internacional, por cuanto:

•    Fue objeto de privación de la libertad, sin mandamiento judicial.

•    Por parte del Departamento Administrativo de Seguridad, se le incomunicó durante el 30 de septiembre y en horas de la mañana del 1 de octubre.

•    A CHRISTINA FRIEDERIKA no le fue permitido entrevistarse con su abogado.

•    CHRISTINA FRIEDERIKA, fue objeto de extenso y detenido interrogatorio por parte del D.A.S., sin permitirle para ello, estar acompañada de su abogado.

•    El 1 de octubre de 2008, por parte de Subdirectora de Extranjería del D.AS., Lilia María Babativa Velásquez, se ordenó la expulsión de CHRISTINA FRIEDERIKA, sin permitirle ejercer su derecho a la defensa, ni interponer recurso alguno en contra de dicha decisión.

•    A CHRISTINA FRIEDERIKA tan solo le fue permitido entrevistarse con un abogado, 15 minutos antes de ser expulsada del país.

Los hechos aquí denunciados, constituyen un claro ataque a la labor de defensa de los derechos humanos en Colombia y tienen como claro y expreso propósito impedir que por parte de la comunidad internacional se observe, documente y denuncie las políticas y prácticas sistemáticas que atentan contra la vida, libertad e integridad personal, así como el desconocimiento de los derechos económicos, sociales y culturales, por parte del Gobierno Colombiano. Preocupa a las organizaciones de la Red, que esta política se convierta en una práctica recurrente,  ya son varios miembros de la comunidad internacional que han sufrido estos atropellos. 
Por lo anterior, los llamamos con URGENCIA, a dirigirse a las autoridades colombianas, Cancillerías en cada país, organismos intergubenarmentales de derechos humanos y representaciones diplomáticas de Colombia en el exterior, a fin de que se exija:

SOLICITUDES

1.     Sean investigados los miembros del DAS que participaron de la detención ilegal y arbitraria de CHRISTINA FRIEDERIKA MÜLLER y los funcionarios que participaron en el arbitrario proceso de su expulsión.

2.    Sea derogado el decreto 4000 de 2004, "por el cual se dictan disposiciones sobre la expedición de visas, control de extranjeros y se dictan otras disposiciones en materia de migración", en lo relacionado con la expulsión y deportación de extranjeros, pues el mismo desconoce las normas del derecho internacional de los derechos humanos, dejando al libre arbitrio de funcionarios administrativos la restricción y eliminación de los derechos humanos, entre ellos a la defensa y debido proceso.

3.    Se solicite al gobierno nacional una explicación de la política que esta ejerciendo en contra de las personas y organizaciones internacionales acompañantes y cooperantes.
